Welcome to Givaro (“Platform”, “App”, “Service”), operated by Giveandtake Limited, a company registered in England and Wales (Company No. 16931925) with its registered office at 24, Heath Wood Drive, Maidstone, United Kingdom (“we”, “us”, “our”).

By downloading, accessing, or using the Givaro mobile application or website, you (“User”, “you”, “your”) agree to be bound by these Terms of Use (“Terms”). If you do not agree to all terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Givaro Ltd.

Prohibited Items: You may not list or request: weapons, hazardous materials, recalled items, illegal substances, live animals, stolen goods, counterfeit items, or anything promoting hate/violence. Full list in Community Guidelines.

Platform Fee: A non-refundable £1 fee is charged to the Taker upon committing to collect an item. This fee reserves the item and unlocks in-app chat.

Delivery Services: Optional delivery is provided by our trusted courier partners. Delivery costs are calculated based on size, weight, and distance, paid by the Taker through our integrated payment system. Delivery terms are subject to the courier’s own terms and conditions.

Refund requests must be submitted via in-app support within 24 hours of collection or delivery.

We use Stripe, Inc., a PCI-DSS compliant third-party payment processor. By using our payment services, you agree to Stripe’s Terms of Service and Privacy Policy. We do not store your full payment card details.

Our discretionary guarantee protects Takers who receive an item that is materially different from its listed description (e.g., broken when listed as “Very Good”). To qualify:

We will investigate, mediate between both parties, and may refund the £1 Platform Fee at our discretion. This is not a product warranty and does not constitute acceptance of liability for the condition of items.

After a successful transaction, the Taker may leave an anonymous 1-5 star rating and an optional comment about their experience with the Giver and the accuracy of the item description.

All comments are moderated by our team before publication to ensure compliance with our Community Guidelines. Ratings are permanent and anonymous.

We reserve the right to remove ratings or comments that violate our Community Guidelines. Users with consistently low ratings may have their accounts restricted.

We own all intellectual property rights in the Platform, including trademarks, logos, and software. You retain ownership of content you post (photos, descriptions) but grant us a worldwide, royalty-free license to use, display, and distribute it for the operation of the Service.

To the fullest extent permitted by English law, we exclude all liability for:

We do not exclude liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded under English law.

We may suspend or terminate your account if you breach these Terms, with or without notice. You may delete your account at any time via the app settings, and your account can be restored within 30 days of deletion, after which it will be permanently deleted. Termination does not affect any rights or liabilities that arose prior.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. We encourage users to first contact us at disputes@giveandtake.uk to resolve issues informally.

We may amend these Terms at any time. We will notify you via the app or email at least 30 days before changes take effect. Continued use after changes constitutes acceptance.
